1. Introduction

Welcome to FlyPro ("Platform", "Service", "we", "our", or "us"). By accessing or using our services at https://www.flypro.io, you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using our platform.

2. App Store End User License Agreement

If you access or download our mobile application through the Apple App Store, the following additional terms apply:

2.1 License Grant and Restrictions

Apps made available through the App Store are licensed, not sold, to you. Your license to the FlyPro app is subject to Apple's Licensed Application End User License Agreement ("Standard EULA"). Apple grants you a nontransferable license to use the Licensed Application on any Apple-branded products that you own or control. You may not distribute, transfer, redistribute, sublicense, reverse-engineer, disassemble, or create derivative works of the Licensed Application.

2.2 Data Collection and Usage

You agree that Apple and FlyPro may collect and use technical data and related information—including technical information about your device, system and application software, and peripherals—to facilitate software updates, product support, and other services related to the Licensed Application. This information may be used to improve products or provide services, provided it does not personally identify you.

2.3 External Services

The Licensed Application may enable access to third-party services and websites ("External Services"). You use External Services at your sole risk. Apple and FlyPro are not responsible for examining or evaluating the content or accuracy of third-party External Services and shall not be liable for any such services. You agree not to use External Services in any manner that infringes intellectual property rights or to harass, abuse, stalk, threaten, or defame any person or entity.

2.4 No Warranty and Limitation of Liability

THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPLE AND FLYPRO DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Apple and FlyPro shall not be liable for personal injury or any incidental, special, indirect, or consequential damages arising from your use of the Licensed Application. Total liability shall not exceed fifty dollars ($50.00).

2.5 Export Control

You may not use or export the Licensed Application except as authorized by United States law and the laws of the jurisdiction where the app was obtained. The app may not be exported to U.S.-embargoed countries or to anyone on the U.S. Treasury Department's Specially Designated Nationals List or Commerce Department's Denied Persons List.

2.6 Governing Law

For users accessing the app through the Apple App Store, disputes shall be governed by the laws of the State of California and subject to the jurisdiction of courts in Santa Clara County, California, except for users who are citizens of European Union countries, Switzerland, Norway, or Iceland, where the governing law and forum shall be the laws and courts of your usual place of residence.

4. Account Registration

4.1 To access certain features of our Platform, you must create an account.

Incorporate user feedback and suggestions into our Platform
Promote and market the Platform using your content

5.3 You retain ownership of your User Content and represent that you have the necessary rights to share it.

5.4 FlyPro reserves the right to:

Remove any User Content violating these Terms
Suspend or terminate accounts for repeated violations
Modify or delete User Content that may harm our Platform's integrity

6. Intellectual Property

6.1 All trademarks, logos, designs, and content on FlyPro are the exclusive property of FlyPro Technologies LLC.

6.2 Users may not:

Reproduce, distribute, or create derivative works of our proprietary content
Use our trademarks without explicit written permission
Attempt to reverse engineer or copy our platform's unique features

7. Subscriptions and Purchases

7.1 FlyPro offers various subscription plans and in-app purchase options.

7.2 Subscription Terms:

Billing is automatic and recurring
Users can cancel subscriptions at any time

7.3 In-App Purchases:

Purchases are final and non-refundable unless otherwise specified

9. User Conduct

10. Limitation of Liability

10.1 FlyPro is not liable for:

Direct, indirect, incidental, or consequential damages
Loss of data or interruption of service
User actions or content

10.2 Our total liability is limited to the amount paid for services in the last 12 months.

11.2 Continued use of the Platform after changes constitutes acceptance of new Terms.

12. Termination

12.1 FlyPro reserves the right to:

Suspend or terminate user accounts
Refuse service to anyone
Limit or disable access to the Platform

13. Governing Law

13.1 These Terms are governed by the laws of the State of Texas.

13.2 Any disputes will be resolved in Travis County, Texas.

13.3 For users accessing our mobile application through the Apple App Store, the governing law provisions in Section 2.6 (App Store End User License Agreement) shall take precedence over this section.
